Service and website terms

1. Introduction

These Terms and Conditions ("Terms") govern the use of IT services provided by ACA Tech Solutions ("ATS", "we", "our", "us"). By engaging our services, you agree to be bound by these Terms.

2. Scope of Services

ACA Tech Solutions provides managed IT services, which include but are not limited to: website development and hosting, email configuration, security and compliance, IT asset management, and ongoing support. Our services may involve the configuration or management of third-party services including but not limited to those from Google, Microsoft, AWS, IONOS, Akamai, etc.

3. Infrastructure and Third-Party Services

We do not operate our own data centers. Infrastructure services are provisioned through third-party providers. While we take due diligence in choosing reliable providers, we are not liable for service interruptions caused by third-party failures, outages, or incidents beyond our control.

4. Optional Redundancy and Resilience

Clients using infrastructure services may opt into redundancy services including failover replicas with alternate providers and/or load balancing across independent ISPs. These options are subject to additional costs and require custom setup.

5. Service Levels and Uptime

ACA Tech Solutions provides reasonable best-effort support. While our managed stack is monitored and maintained, we cannot guarantee uninterrupted availability, particularly when third-party providers are involved. Custom SLAs may be negotiated separately.

6. Account Creation and Client Responsibility

Clients are responsible for the accuracy of information provided during onboarding. Where applicable, clients may receive portal access to track services and request support. The security of account credentials remains the responsibility of the client.

7. Billing and Payments

Fees for services will be detailed in your service agreement or invoice. Unless otherwise agreed, monthly or annual billing applies. Late payments may result in service suspension.

8. Intellectual Property

Clients retain ownership of their own data. ACA Tech Solutions retains the intellectual property of tools, scripts, automation, or configurations developed internally unless expressly transferred.

9. Privacy and Data Protection

We collect and process client data in accordance with our Privacy Policy and the UK GDPR. By using our services, you consent to such processing and you warrant that all data provided by you is accurate.

10. Termination

Either party may terminate service by providing notice per the terms of their service agreement. Clients remain responsible for all fees accrued up to termination.

11. Liability and Indemnity

We shall not be liable for any loss or damage arising from third-party service disruptions, client negligence, or force majeure events. Clients agree to indemnify us against claims resulting from misuse of our services.

12. Amendments

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
